18 U.S.C. § 2257 Exemption

Because all content on PromptCache is created via artificial intelligence and does not depict actual human conduct or "actual sexually explicit conduct" as legally defined, PromptCache is exempt from the record-keeping requirements of 18 U.S.C. § 2257 and its associated regulations.

As per 18 U.S.C. § 2257(f)(1), the record-keeping requirements apply only to content depicting "actual sexually explicit conduct" produced using "actual human being[s]." Since no actual human beings function as "performers" in the creation of AI-generated content on this platform, no § 2257 records are required or maintained.
